Experts advise: China's auto parts industry is facing foreign "patent warfare"


Experts remind that foreign large-scale automobile companies have begun to collect evidence of infringement of domestic companies and are ready to "get trouble."

"The goods are marked with a patent number, but also have a certificate of patent certification?" The author of the Guangzhou IPR law enforcement team conducted inspections on a number of auto parts markets in the city and found that there were many "blind intellectual property rights" among auto parts operators. Experts reminded this: foreign automotive companies have applied for a large number of patents in China to collect evidence that domestic companies infringe their patent rights. If they do not raise awareness of intellectual property rights, domestic auto parts companies will not fight back once the “patent war” is launched.


In the two consecutive days of auto parts products and patent tagging confusion, law enforcement officers from the Guangzhou Municipal Intellectual Property Office, the Municipal Intellectual Property Inspection Team, and the districts divided into three roads to carry out patent product inspections and law enforcement propaganda in 21 auto parts markets in Guangzhou. Only one day, the law enforcement team inspected nearly 200,000 items in 1800 stalls in 16 markets.

In Yiyun Square, which specializes in auto parts in Guangzhou, inspectors randomly selected various auto parts products and found many problems. Some auto parts products are marked with the words "This product has applied for a patent," "patent products, and counterfeiting" on the packaging, but the most critical patent numbers have not been indicated; some patents appearing on the products do not appear to be a problem. However, the stall owner did not have a patent certificate that could prove the authenticity of the patent number; other products indicated the words “patent has filed in the United States” and the inspectors pointed out that the patent application and protection were territorial and did not apply for a patent in China. Is not protected by our country's intellectual property law.

According to the relevant regulations of the country, listed products must be marked in Chinese, and imported products are no exception. Many auto parts products are in vitro and people can't tell the authenticity of "imported products." All the products sold at a stall are marked in English. Inspected by the inspectors, the stall owner argues that the factory is located in Huadu and the products are mainly exported in full English. Law enforcement officers immediately corrected and alerted them.

The author found that many stall owners do not understand intellectual property rights, and some attitudes are quite indifferent. In order to expand the publicity of intellectual property rights, law enforcement officers specially sent out some intellectual property promotion cards to various stalls, and some inspectors, such as stalls, tossed the cards into garbage bins.

Collect evidence, foreign companies want to fight "patent warfare"

It is understood that foreign large-scale automobile companies have applied for a large number of patents in China, and have begun to gradually collect evidence of domestic companies infringing their patent rights, and they have not shown a tendency to be cited, and they are ready to launch problems when the time is ripe.

Automobiles have become one of the pillar industries in Guangzhou. Honda, Nissan, and Toyota, the three major international automobile manufacturing companies, have settled in Guangzhou. If they do not raise awareness of patent protection as soon as possible, some companies will face the competitor's long-standing patent infringement litigation.

Repeated actions to inspect infringement products According to reports, since September of this year, Guangzhou Regulatory Office organized patent, industry and commerce, quality supervision and other functional departments to launch anti-counterfeiting and counterfeit products, protection of intellectual property rights, and maintenance for Guangzhou auto parts industry. The special rectification actions of the market economic order mainly targeted counterfeiting of trademarks, counterfeit brands, "three nos" (bad) products and patent infringement products. At present, the first phase of the rectification work has been effective, and the action marks the formal commencement of the second phase of the intellectual property protection of the auto parts industry in Guangzhou.
